By the present, JPARD SOLUTIONS S.R.L. with its headquarters in Romania, Cluj Napoca, 57A Cardinal Iuliu Hossu Street, Cluj County, registered at the Trade Register Office attached to the Cluj Tribunal under order no. J12/335/2015, unique registration code 34070990 (hereinafter referred to as “the Company”) respects confidentiality and is committed to protecting the personal data of candidates in accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679. This agreement explains how we collect, use, disclose, and protect your personal information during the recruitment process

 

Data Collected

The Company may collect and process the following categories of personal data of candidates:

  • Identification information: name, surname, home address, date and place of birth, personal identification number (where necessary).
  • Contact information: phone number, email address.
  • Employment and educational data: CV, cover letter, diplomas, certifications, employment history, references.
  • Additional information: letters of recommendation, portfolios, aptitude test results, interview notes

 

Purpose of Data Processing

JPARD SOLUTIONS S.R.L. is obliged to process in secure conditions and only for the purposes specified below, the personal data you provide us with about yourself.

The collected data will be used exclusively for the following purposes:

  • Evaluating qualifications and compatibility with the position you applied for or other compatible positions within the company.
  • Managing and administering the recruitment process.
  • Communicating with you regarding the recruitment process.
  • Fulfilling legal and compliance obligations

 

Legal Basis for Processing

The processing of your data is based on the following legal grounds:

  • Explicit consent of the candidate.
  • The necessity of processing data for the conclusion of an individual employment contract or to take steps at the request of the candidate before concluding a contract.
  • Specific legislation in the field in which the Company operates.
  • The legitimate interest of the Company to carry out recruitment activities

 

Data Disclosure

Your personal data may be disclosed to:

 

  • Exclusively authorized persons within the company who, by the nature of their position, may or is required to have access to this informationThird party service providers that support the recruitment process (e.g. online recruitment platforms, recruitment agencies, HR Admin and Personnel Management platforms).
  • Central/local public authorities, educational and educational institutions, the judiciary, prosecuting authorities and other institutions authorized by law to request information.

 

Data Retention Period

Your personal data will be kept for the period necessary to achieve recruitment purposes, but no longer than 5 years from the completion of the recruitment process, unless applicable legislation provides otherwise or if you have given consent for a longer storage period

 

 

Your Rights

In accordance with GDPR, you have the following rights regarding your personal data:

 

  •  Right of access to personal data: You can request confirmation as to whether your personal data is being processed and information about the processing.
  • -Right to rectification: You may request the correction of inaccurate personal data as well as the updating of personal data in the event of any changes to your personal data.

 

  • Right to erasure: You can request the deletion of your personal data
  • Right to restriction of processing: You can request restriction of the processing of your data under certain conditions.

 

  • Right to data portability: You can request the transfer of your data to another controller.
  • Right to request restriction of processing (e.g. if some data are inaccurate or processing is not lawful)

 

  • Right to object: You can object to the processing of your data on the basis of a legitimate interest of the Company.
  • Right to withdraw consent: You may withdraw your consent at any time, without affecting the lawfulness of the processing based on your consent prior to the withdrawal of consent.
  • The right to have your personal data transferred (portability of personal data) to another personal data controller determined by you.
  • The right to receive a notification from the controller (the Company), in the event that the controller (the Company) is constantly in breach of the security measures for the processing of your personal data;
  • The right to lodge a complaint to JPARD SOLUTIONS S.R.L., respectively to the National Authority for the Supervision of Personal Data or to a competent court in the situation in which you consider that the processing of your personal data violates the General Data Protection Regulation (GDPR) (EU) 2016/679.

By signing this agreement, you confirm that you have read, understood, and accepted the terms and conditions of this GDPR agreement regarding the processing of personal data in the recruitment process

Confidentiality

By signing this agreement, I declare that I have been informed and understood that all information regarding any type of tax exemptions and contributions to the second pension pillar are considered strictly confidential. This information will be disclosed after signing the individual employment contract for the purpose of calculating monthly salary rights, exclusively to authorized persons in the company who, by the nature of their position, can or need to have access to this information.

This agreement can be signed electronically. The use of an electronic signature will be, for purposes of validity, applicability, and admissibility, conclusive evidence of the signatory’s intention to be legally bound, similar to a handwritten signature.
